QUOTATIONS:
All quotations are valid for 30 working days.
CHANGES:
Please note that should the nature of the maintenance change or you would like something changed within the quote, a new quote will be required.
PAYMENT:
Payment can be made by either cash or bank transfer and a receipt for payment will be given. Bank Transfer details can be found at the bottom of your invoice. Payment in full is due upon completion of the contract and presentation of the associated invoice. Part payments, interim payments, and deposits will be agreed upon prior to the commencement of works or during the contract duration. A down payment is not usually required however arrangements may be made for a down payment in respect of the acquisition of bespoke or high-value materials and in some other situations. All goods remain the property of PD Paving Services until paid for in full. Monies that remain outstanding by the due date will incur late payment interest at the rate of 4.25% above the prevailing Bank of England’s base rate on the outstanding balance until such time as the balance is paid in full and final the settlement. We reserve the right to seek recovery of any monies remaining unpaid 30 days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.
CANCELLATIONS:
You have the right to cancel this agreement within 14 days of the date set out on the front page of your quotation/contract, as this is the date on which you received a copy of this agreement. You can cancel the agreement by sending a clear notice of cancellation by email to pdpavingservices@gmail.com.
You may use the cancellation notice set out below for this notice, but it is not obligatory. We will identify the contract from your name and address, so we do not need any other reference number or code. Your notice is deemed to be served as soon as it is posted or in the case of emails on the day it is sent. Sometimes, however, written notices may be lost or delayed in the postal system and you may need to prove that the notice was properly addressed, stamped, and placed in the post. We, therefore, recommend that you send the notice by recorded delivery or other similar delivery so that, if we reasonably request, you may easily prove that the notice was properly addressed, stamped, and placed in the post. Similarly, emails may not reach their destination and you may need to prove that the email was properly addressed and sent. We, therefore, recommend that you select options for delivery and read receipts before sending.
- a) If you exercise your right to cancel this agreement within the 14-day cooling off period we will reimburse you all payments received from you.
- b) If you requested for Works to begin during the 14-day cancellation period, but decided to cancel the agreement within the 14-day cooling off period, you will pay to us an amount which is in proportion to the Works carried out up until the date on which you communicated to us your cancellation of this agreement. Please note that we contractually commit to the supply of materials and subcontractors soon after we enter this agreement. We will be entitled to set off this amount against any deposit or other payments made by you to us.
DAMAGE:
a) We are fully insured. In the rare event of an operator causing damage to your property, please report the matter to us by phone within 24 hours, with full particulars provided in writing (email or letter) within 7 days.
b) We will not be liable for any damage to Works or materials where that damage results from (a) algae (b) the use of chemicals, bleaches or contaminants by you (c) damage, neglect, negligence, misuse, alteration or staining; (d) movement, expansion or contraction of subsoil; (e) deterioration caused by temperature, weather, water, water content, tree roots or other natural occurrence; (f) repair or rectification of any alleged defect by anyone not authorised by or affiliated with us; (g) a failure to follow our instructions for the care of the Works and materials; (h) any use that is not reasonable or consistent with the purpose of the Works; (i) wear and tear; (j) a failure to follow manufacturers recommendations for the care of the Works and materials; (k) any use that is not reasonable or consistent with the materials selected for the Specification of Work because of a failure to notify us of unusual usage for the Works or the use of the Premises for commercial purposes or heavy loads; (l) weed and moss growth that can occur between paving blocks as, for example, airborne seeds settle into the sand and we are not responsible for such growth. Furthermore we cannot be held responsible for damage caused to any existing utility services, pipes and cables that have been not been installed correctly and to the compliant building regulation depths.
OUR GUARANTEE:
All customers will benefit from a full guarantee on our workmanship for a period of 5 years, the guarantee covers all work by PD Paving Services Guarantees on materials run in accordance with the manufacturer's warranty periods where applicable. Our guarantee covers all new work and new materials used in construction but does not guarantee the integrity of any existing structures, materials or decorations. 5b) is not covered by this guarantee. Subsidence issues (sinkage below slabs, subsidence below new or existing foundations or movement of foundations or floors etc) are not covered within our guarantee agreement. In the event of a failure beyond the guarantee period, we will be happy to investigate the cause and negotiate a solution to the problem without delay (if it is found that our company is wholly responsible for the failure) and carry out any agreed repairs as soon as possible. Charges may apply for remedial work carried out beyond guarantee dates or to items not covered by our guarantee. Decorations are signed off on completion and not covered by the guarantee.
DELAYS TO THE SERVICE DAY:
Due to circumstances beyond our control including, but not limited to, adverse weather conditions, inclement, equipment failure, failure of transport networks, late delivery by suppliers or sub-contractors, additional requests by you, or ill health, we may be delayed by 48 hours for the service day – we appreciate your understanding.
MARKETING:
You permit us to display a sign, notice or advertisement which can be seen from outside the Premises giving our name and contact details;
Confirmation of acceptance of a job means your acceptance of our terms & conditions.
Work is taken as acceptance of our terms & conditions.
